suit against Kronotex before the Düsseldorf

Akzenta has
preferred a suit (4b O 165/07) before
the Düsseldorf District Court against Kronotex for
violation of the European patent
EP 1 002 170 with respect to a
beech grain laminate floor covering of the latter
that Akzenta claims does not provide a facility
for a laminate ply, but applies the laminate
directly to the base that is then processed to
yield a prefabricated layer.
There
are two reasons that Kronotex claims will
effectively lead to a dismissal of the case:
first, Kronotex does not apply woodgrain
laminates, as specified in the patent, to the
base, and secondly, there is doubt as to the
validity of the patent constituting the cause of
action.
Kronotex
will therefore counter the violation suit with
arguments and in addition bring a revocation
action against the German interest in the European
patent before the Federal Patents
Court.
